Introduction

The terms and conditions of this Arborist Services Contract (the "Arrangement") govern the commercial agreement between Company Name with its major place of business at (the "Arborist") and Template (the "Client") who agrees to be bound by this Agreement.

WHEREFORE, the Arborist's business is to provide arborist services; and

WHEREAS, the Client wishes to retain the Arborist's services to provide landscaping services in accordance with the Client's design and direction, according to the terms and conditions set out herein.

NOW, THEREFORE, the Arborist and the Client (individually, each a "Party" and collectively, the "Parties") covenant and agree as follows in consideration of the reciprocal covenants and promises made by the parties hereto:
The Property

(the "Property") is the site where the Arborist will conduct such services. The Client warrants and certifies that the Client either owns the Property or has the permission to employ the Arborist for the requested Arborist Services.
Arborist Services

With an arsenal of cutting-edge tools and equipment, your property will be trimmed and maintained to the very best standards.
Compensation

The Client should pay the Landscaper [WRITTEN DOLLAR AMOUNT] dollars ($[NUMERICAL DOLLAR AMOUNT]) per hour plus the cost of materials in exchange for the Consulting Services. Although this is only an estimate, the projected cost for [TIME FRAME] is [WRITTEN DOLLAR AMOUNT] dollars ($[NUMERICAL DOLLAR AMOUNT]). The Landscaper will invoice the Client once every [TIME PERIOD], and such bills will be due and payment within [NUMBER] days after receipt of the invoice by the Client.

Trees will be felled to ground level. Our arborists will do a straight fell if space allows for it. If space is restricted our arborists will do a sectional fell, where they will climb the tree(s) and dismantle from within.

All debris and waste will be cleared and removed from site. Let us know (in the comments below) if you would like to keep this waste as a garden mulch.

This will be done using tried and true methods of pruning and thinning to promote growth into the desired shape.

Maintaining a high level of site safe work practices, our arborists will also remove any damaged or weak branches, leaving you with mature trees that grow healthily and proudly on your property for years to come.

Our machines will quickly and easily grind the stumps below ground level. We will also remove debris and replenish the hole(s) with fresh soil, ready for grass seed.

Client Responsibilities

To guarantee that the Landscape Services are adequately provided, the Client is responsible for the following:

  1. Inform the Landscaper about the Property's landlines so that the Arborist does not intrude on any third party's property.
  2. Provide the Arborist with accurate information about any underground utility and service lines, such as electricity, telephone, and gas lines.
Arborist Responsibilities

The Arborist is accountable for the following when providing Arborist Services:

  1. Obtaining any necessary permits for the Arborist Services.
  2. Supervise the purchasing of materials for the Arborist Services.
  3. After completing the landscaping services, clean the property and eliminate all debris.
  4. Obtaining liability insurance for personal injury, death, and property damage in the amount of [WRITTEN DOLLAR AMOUNT] dollars ($[NUMERICAL DOLLAR AMOUNT]) per occurrence.
Promotion

The Client hereby authorises the Arborist to take photographs of the Client's property at the Arborist's discretion for the purpose of promoting the Arboristr's Services and provides the Arborist sole intellectual property rights in any such photographs.
Indemnification

The Client agrees to pay, defend, and hold the Arborist harmless from and against any and all lawsuits and costs arising out of the Services, any false information provided by the Client regarding the Property, or the Client's failure to provide pertinent information.
No Modification Unless in Writing

No amendment of this Agreement will be valid unless both parties agree in writing.
Applicable Law

The laws of the State of [STATE] shall govern and construe this Consulting Agreement, and the interpretation of its terms shall be subject to the exclusive jurisdiction of the federal and state courts located in [COUNTY], [STATE].
Acceptance

IN WITNESS WHEREOF, each of the Parties, by its properly authorised official, has executed this Consulting Agreement as of the date and year set forth below.
