Introduction

The terms and conditions of this Landscaping Services Contract (the "Arrangement") govern the commercial agreement between Company Name with its major place of business at [ADDRESS] (the "Landscaper") and (the "Client") who agrees to be bound by this Agreement.

WHEREFORE, the Landscaper's business is to provide landscaping services; and

WHEREAS, the Client wishes to retain the Landscaper's services to provide landscaping services in accordance with the Client's design and direction, according to the terms and conditions set out herein.

NOW, THEREFORE, the Landscaper and the Client (individually, each a "Party" and collectively, the "Parties") covenant and agree as follows in consideration of the reciprocal covenants and promises made by the parties hereto:
The Property

(the "Property") is the site where the Landscaper will conduct such services. The Client warrants and certifies that the Client either owns the Property or has the permission to employ the Landscaper for the requested Landscaping Services.
Term

The Landscaper shall undertake the Landscaping Services described herein for [TOTAL TIME FRAME] once every [PERIOD].


a. Either Party may terminate this Agreement for any reason by giving the other Party [NUMBER] days written notice.
Landscaping Services

The Landscaper agrees to perform the landscaping services outlined on Exhibit A (the "Landscaping Services") attached hereto. The cost of services and/or materials may increase if the Client alters the scope of the Landscaping Services after signing this Agreement.
Compensation

The Client should pay the Landscaper [WRITTEN DOLLAR AMOUNT] dollars ($[NUMERICAL DOLLAR AMOUNT]) per hour plus the cost of materials in exchange for the Consulting Services. Although this is only an estimate, the projected cost for [TIME FRAME] is [WRITTEN DOLLAR AMOUNT] dollars ($[NUMERICAL DOLLAR AMOUNT]). The Landscaper will invoice the Client once every [TIME PERIOD], and such bills will be due and payment within [NUMBER] days after receipt of the invoice by the Client.

Client Responsibilities

To guarantee that the Landscape Services are adequately provided, the Client is responsible for the following:


a. Inform the Landscaper about the Property's land lines so that the Landscaper does not intrude on any third party's property.


a. Provide the Landscaper with accurate information about any underground utility and service lines, such as electricity, telephone, and gas lines.
Landscaper Responsibilities

The Landscaper is accountable for the following when providing Landscaping Services:


a. Obtaining any necessary permits for the Landscaping Services.

b. Supervise the purchasing of materials for the Landscaping Services.

c. After completing the landscaping services, clean the property and eliminate all debris.

d. Obtaining liability insurance for personal injury, death, and property damage in the amount of [WRITTEN DOLLAR AMOUNT] dollars ($[NUMERICAL DOLLAR AMOUNT]) per occurrence.
Promotion

The Client hereby authorises the Landscaper to take photographs of the Client's property at the Landscaper's discretion for the purpose of promoting the Landscaper's Landscaping Services, and provides the Landscaper sole intellectual property rights in any such photographs.
Indemnification

The Client agrees to pay, defend, and hold the Landscaper harmless from and against any and all lawsuits and costs arising out of the Landscaping Services, any false information provided by the Client regarding the Property, or the Client's failure to provide pertinent information.
No Modification Unless in Writing

No amendment of this Agreement will be valid unless both parties agree in writing.
Applicable Law

The laws of the State of [STATE] shall govern and construe this Consulting Agreement, and the interpretation of its terms shall be subject to the exclusive jurisdiction of the federal and state courts located in [COUNTY], [STATE].
Acceptance
